Q. I have received court papers for careless driving and dangerous driving on the same occasion. Why is this and what is the difference?

A. The court will be asked to decide if you are guilty of dangerous driving in the first instance. This is the more serious of the two offences. If the court thinks you are innocent of this they will be asked by the prosecution to consider finding you guilty of the less serious charge of careless driving. Dangerous driving involves a standard of driving falling far below the standard of reasonable and prudent driving. Careless driving involves a fall below the same standard not far below. |
