Cases of dangerous and careless driving are often linked and can indeed be very similar. A case of careless driving involves a standard of driving falling below that of a reasonable driver. Dangerous driving is a more serious offence and will involve a far worse standard of driving.
Careless driving will be dealt with in a magistrates court and will normally attract a fine and penalty points if you plea guilty or are found guilty. Only serious cases of careless driving will lead to the possibilty of a driving disqualification.
Examples of careless driving will involve minor road traffic accidents.Careless driving can also include things such as not being in control of a vehicle by reason of eating or smoking whilst driving. Normally a breach of the highway code would be an example of careless driving.
We have respresented a large number of people on careless driving matters. If you need advice upon whether a matter that you face may amount to careless driving then please get in touch.
Dangerous driving is more serious. Cases can be referred to the Crown Court for trial. All cases will start in the Magistrates Court. If you are found guilty of dangerous driving you will face a driving ban and re test. The court is not likely to fine you and may impose a prison sentence in the most serious cases. A community sentence such as probation or unpaid work in the community may also be considered.
Examples of dangerous driving may include driving at speeds far in excess of the speed limit, cases involving serious accidents and potential dangerous situations such as undertaking on a motorway.
If you face a charge of dangerous driving then the court can find you guilty of the lesser charge of careless driving.
