In particularly bad cases, it can lead to more serious offences being charged and even the imposition of a prison sentence in particularly serious cases. The time when a police officer would verbally warn a motorist for the use of his mobile phone whilst at the wheel of his vehicle are long gone. Courts take a particularly serious view of this offence.

Drivers can also be affected by the issuing of fixed penalty tickets. If a person is disqualified from driving they can, in certain circumstances, apply for their disqualification to be removed. Any such application will need to be made to the Court that imposed the original disqualification. Applications of this type can only be made after a minimum period of two years if the disqualification is less than four yeas, after one half of the disqualification in cases of between four and ten years and five years in any other case.
 
In deciding such an application, the Court will examine the facts of the original offence, any other circumstances and the character of the applicant together with his conduct since the disqualification was imposed.
