Q. I have been sent a summons for speeding. When I was stopped at the roadside I saw no signs warning of speed enforcement. Does this affect my Case?

A. No. There is no obligation on the police to warn motorists of the presence of static or mobile cameras. |

Q. I have been taken to court for not disclosing who was driving my vehicle when it was flashed by a speed camera. Surely this is my right under The Human Rights Act?

A. No. Unfortunately the courts have decided that the Act does not cover this situation. If you do not disclose who the driver was then you commit an offence. |

Q. I was caught speeding and received a summons to go to court seven months after the offence. Is this too late?

A. The summons must be issued by the court within six months and one day of the offence. If this time period is complied with it does not matter that you recieved the summons outside this same time period. |

Q. I have received a speeding ticket for just over 100mph. A friend has advised me I will automatically lose my licence at court.

A. No. The court will consider disqualification at this speed but it is not automatic and each case is decided on its own facts. |
